U.S. Trademark Registration
United States Patent and Trademark Office (USPTO)
Register your trademarks in the United States through the USPTO. Foreign applicants must use a U.S.-licensed attorney since August 2019.
Mandatory U.S. Attorney Rule (Since August 2019)
All foreign-domiciled applicants (individuals or businesses with principal place of business outside the U.S.) must be represented by a U.S.-licensed attorney for USPTO filings and Office Actions.
You can draft strategy and prepare materials, but a U.S. attorney must formally file applications and respond to USPTO Office Actions.
"Use in Commerce" Standard
The U.S. uses a "Use in Commerce" standard, but Canadian owners have strategic filing advantages through intent-to-use and foreign registration bases.
